Immigrant Visas Available for Family-Based Immigration to the United States

Whether you would like to come to the United States permanently or if you would like to stay only for a temporary period of time, there may be a family-sponsored visa that is just right for your circumstances.

Immediate Relative Visa

When a family member is an immediate relative, they may have the easiest pathway to come to the United States and have to wait the shortest amount of time. Additionally, these visas are unlimited. Immediate family members are considered to be:

  • A spouse of a U.S. citizen
  • An unmarried child of a U.S. citizen who is under the age of 21.
  • An orphan that was adopted or will be adopted by a U.S. citizen.
  • A parent of a U.S. citizen who is 21 years of age or older.

Family Preference Visas

There is a limit to the number of family preference visas available each year. Family preference visas are applicable for:

  • Family First Preference (F1) for unmarried children of a U.S. citizen and their children.
  • Family Second Preference (F2) for spouses, minor children, and unmarried children that are over the age of 21 of lawful permanent residents.
  • Family Third Preference (F3) for married children of U.S. citizens and minor children.
  • Family Fourth Preference (F4) is for siblings of U.S. citizens aged 21 and older, as well as their spouses and minor children.

Family-Based Immigration Visa Caps

For immediate relative visas, there are no caps. However, they are for family preference visas. When the cap has been met, but all approved family members have not started the process of coming to the U.S., then they will be given a priority date for eligibility.
