Immigration Process

Every case is different, and no outcome can be guaranteed. However, knowing the basic steps of the immigration process can aid you along the way. Here are a few common questions that our clients ask, and what those seeking U.S. citizenship can expect. For information specific to your case, call for a consultation. 

1. Schedule a Consultation with an Immigration Attorney

Immigration laws can be difficult to understand due to their complexity. Policies are constantly changing as new laws are passed, so before you attempt to do anything on your own, speak to an immigration attorney. We can provide a detailed analysis of your situation and help you understand your options. Whether you are seeking permanent residency through a green card or want to be naturalized into a U.S. citizen, an attorney is an invaluable resource. 2. Gather Evidence and Documents

Typically, whether you are applying for citizenship, a visa, a green card or another immigration process, you will need to gather sufficient documentation. Relevant documents include tax filings, criminal records, birth certificates and anything else we believe pertains to your application. Completing your evidence before beginning the immigration process may help reduce processing times. 

3. Prepare Your Application

Applicants will need the relevant government officials to approve their immigrant application. This organization will assign your case a number. 4. Submit Your Application

While most of the evidence required for immigration applications can be submitted online, there are a few exceptions that must be sent through mail. Processing times for applications vary depending on your exact circumstances, and it’s common for agencies to request additional documentation. 

5. Case Follow

The exact timeframe for processing times in an immigration case depends on the specific type of status you are trying to receive. For instance, the naturalization process can take up to several months in Indiana but can take up to two years in other states before an individual becomes a U.S. citizen. Certain visas may take several months in comparison. There are also some delays in processing to be aware of, which is why working with an attorney is essential.  

6. The Interview

The immigration process typically involves an interview with USCIS to confirm that you fulfill all requirements for citizenship or permanent residency. You may be required to attend a biometrics appointment where you’ll provide fingerprints and photos. Our attorneys can help you prepare. 

The interview will take place at a consulate if the applicant is residing outside of the U.S. or if the applicant does not qualify for adjustment of status, or at a field office if the applicant lives in the U.S. and qualifies for Adjustment of Status. You must provide original documents at this appointment and complete all medical and security checks. 

7. Approval

Once you’ve been approved, you will receive specific instructions on further instructions for how to enter the U.S. if necessary. If applying for a green card, you’ll receive it through the mail at your U.S. address or your attorney’s address.
