All About Asylum

Asylum is the application a person makes when they are fearful of returning to their home country and is different than refugee status, which can only be applied for outside of the U.S. One of the first steps we take in evaluating a claim for asylum is determining whether the individual is eligible for claiming asylum. There are core requirements for establishing asylum, such as persecution based on sex, sexual orientation, political affiliation, religion, national origin, or membership of a social class. Also, it is imperative that you apply within one year of entering the United States.  A credible fear interview (CFI) is not an asylum application.

Another primary consideration for asylum seekers is the country of origin. Some countries target certain groups based on sexual orientation, others based on religion or national origin. Determining your country of origin can also help determine what potential consequences or penalties the person will face upon arrival in their home country. The penalties may include anything from flogging, imprisonment, or even the death penalty.

Confidentiality And Trust Are Vital
